CANCER MEDICINES: WILL PATIENTS GET THE FULL BENEFIT OF THE NEW PRICE CAP?

BIZ MASALA  |  SIGNATURE STORY

India has capped trade margins on 137 non-scheduled anti-cancer drugs. The next test is whether the promised savings reach patients.

India’s new cancer-drug pricing order is significant—but the headline number is only the beginning. On 17 October, the National Pharmaceutical Pricing Authority (NPPA) notified a 30% trade-margin cap covering 137 identified non-scheduled anti-cancer drugs. Revised prices are scheduled to take effect on 9 November 2026. The government says maximum retail prices could fall by as much as 70%, depending on the existing price structure. That is a possible maximum, not a uniform reduction for every medicine.

What exactly has changed?

India already regulates prices of medicines on the scheduled list through ceiling prices. The latest order targets identified non-scheduled anti-cancer formulations—medicines outside that standard ceiling-price framework. Using the Trade Margin Rationalisation mechanism under Paragraph 19 of the Drugs (Prices Control) Order, 2013, the NPPA is limiting the permitted trade margin for the covered products.

In plain language, the regulator is targeting the mark-up between the price at which a medicine first enters the supply chain and the price charged downstream. It is not a promise that every medicine will be 70% cheaper, nor does the order mean that the manufacturer’s own production price has been cut by 70%. The actual change depends on the existing price and margin structure of each covered product.

The policy aims to control the distribution and retail mark-up on the medicines listed in the notification. Actual invoices and revised price lists will show how the change flows through each channel.

The medicines—and the patients behind the list

How the pricing rule moves through the supply chain. Editorial illustration; not a depiction of a specific company or patient.

The announced list includes medicines used in modern cancer care, including immunotherapies, targeted therapies and supportive treatments. News reports identify drugs such as pembrolizumab, nivolumab, osimertinib, palbociclib, ribociclib, abemaciclib, atezolizumab and bevacizumab among the medicines covered. These examples are not a substitute for checking the exact formulation, strength and dosage form in the official NPPA notification.

Important price-data limitation: The Gazette notification lists 137 drug ingredients/combinations, not one old and one new price for each ingredient. Prices depend on brand, strength, dosage form and pack size. The notification uses each formulation’s March 2026 price-to-stockist/distributor to calculate the permitted MRP. Since manufacturers must submit revised MRPs after publication and the new prices take effect on 9 November 2026, a reliable old-versus-new price table for every formulation is not yet available from the notification itself. We therefore do not invent or imply a single price per molecule.

Example medicine

Why it matters (brief, non-exhaustive)

Pembrolizumab / nivolumab

Immunotherapy medicines used in several cancer settings; use depends on diagnosis and clinical guidance.

Osimertinib

Targeted therapy used for certain forms of lung cancer.

Palbociclib / ribociclib / abemaciclib

Targeted medicines used in selected breast-cancer treatment regimens.

Atezolizumab

Immunotherapy used in specified cancer indications.

Bevacizumab

A targeted medicine used in several cancers, depending on indication.

Pegfilgrastim

Supportive treatment that helps reduce the risk of certain low-white-cell complications during cancer treatment.

Denosumab

Used in certain settings involving bone complications; the indication and product formulation matter.

The ₹2,500-crore promise needs a receipt

The government has estimated that the intervention could save patients around ₹2,500 crore annually. That is a policy estimate, not a measured outcome yet. To judge it fairly, readers need to know the assumptions behind the estimate: which products and sales volumes were counted, how existing prices were compared with revised prices, and how much of the reduction is expected to reach patients who buy medicines through hospitals rather than retail pharmacies.

The government’s earlier 2019 trade-margin rationalisation exercise covered 42 anti-cancer drugs. The Centre says that exercise led to price reductions across 526 brands, with reductions of up to 90%. That history suggests that margin regulation can move prices—but it does not automatically prove the savings claimed for the expanded 2026 list. The new measure must be evaluated on its own results.

Illustration only: the bars demonstrate simple arithmetic, not an actual medicine price, the effect of this order, or a forecast. Actual reductions will differ by product.

Who must do what before 9 November?

·       Manufacturers must submit revised prices to the NPPA within seven days of publication of the notification and publish/disseminate the revised price lists as directed.

·       Retailers and hospitals must charge the applicable revised prices from the effective date and display the relevant information, according to the government’s instructions.

·       State drug controllers and the relevant authorities must monitor compliance. Patients and caregivers should compare the exact brand, strength, dosage form and pack size—not just the medicine name.

·       Where medicines are supplied directly to hospitals, implementation inside hospital procurement and billing systems will be crucial. A lower maximum retail price is meaningful only if the bill charged to the patient reflects the applicable rule.

The enforcement question

The practical test: whether the revised, formulation-specific price appears on pharmacy and hospital bills. Editorial illustration.

A notification can set the rule; it cannot by itself guarantee compliance at every counter. The most useful public test will be a product-by-product comparison of old and revised MRPs, matched against invoices from pharmacies and hospitals after 9 November. The regulator should make the revised lists easy to find, explain how patients can report overcharging, and publish enforcement outcomes in a form the public can understand.

This is also a supply question. Price controls need monitoring for availability as well as affordability. The government has directed manufacturers to maintain supply of the covered medicines. The follow-up should check whether products remain available and whether patients are pushed toward different brands or formulations. There is no basis, at this stage, to claim that shortages will occur; it is a risk to monitor, not a conclusion.

Why only cancer drugs? The wider pricing debate

The timing is important. Recent Supreme Court reporting has described the court pressing the government to explain why action on excessive medicine and medical-device mark-ups should not extend beyond cancer drugs. That raises a wider question for health policy: should India rely on targeted interventions for selected products, or develop a more transparent system for identifying and addressing excessive mark-ups across essential medicines and devices?

The counterargument also deserves a hearing. Supply chains cost money to operate, and distribution margins help medicines reach patients across regions. The policy question is not whether every margin is improper. It is whether margins are reasonable, transparent, and consistent with affordable access—especially when patients have limited choice and treatment cannot easily be postponed.

What patients should check

·       From 9 November 2026, ask the pharmacy or hospital for the revised price applicable to the exact brand, strength, dosage form and pack.

·       Keep the bill and compare the charged price with the displayed revised price list. Do not compare different strengths or pack sizes as if they were identical.

·       Use the NPPA’s official website and its Pharma Sahi Daam resources to check price information and complaint channels.

·       Do not stop, delay or substitute cancer treatment based on a price headline. Discuss any change of brand, formulation or treatment with the treating oncologist.

Biz Masala assessment

The policy deserves attention, but the test is not the announcement—it is the patient’s bill. The 30% cap creates a regulatory benchmark for 137 identified non-scheduled anti-cancer drugs. The claimed savings of up to 70% and ₹2,500 crore annually remain estimates until revised prices are implemented and measured. Biz Masala will be able to assess the policy properly by comparing official price lists, real invoices, product availability and enforcement results after 9 November.

APPENDIX: ALL 137 DRUGS COVERED BY THE NPPA ORDER

Gazette notification dated 17 October 2026 • Effective date: 9 November 2026

The list below reproduces the 137 entries in Table B of the notification, with obvious spelling variants standardized for readability. Legal coverage should always be checked against the original Gazette notification and the exact formulation. The list includes individual drugs and specified combinations.

Why there are no old/new prices beside each drug: Table B is a list of drug names, not a brand-wise price schedule. One ingredient can appear in multiple brands, strengths, dosage forms and pack sizes, each with its own MRP. The Gazette’s formula uses the relevant March 2026 price to stockist/distributor (PTS/PTD), with trade margin capped at 30% and applicable GST. Revised formulation-level MRPs must be taken from manufacturer price lists/NPPA records; they should not be guessed from the molecule name.

Price calculation in the notification: The order specifies a maximum 30% trade margin and a formulation-level MRP calculation based on the March 2026 PTS/PTD, plus applicable GST. A 30% trade margin on MRP corresponds to a 42.86% mark-up on PTS/PTD before GST; it does not mean every medicine’s MRP will fall by exactly 30%. The actual reduction depends on the earlier price and distribution structure.
